How we use your personal information
Information You Give Us
Mobi collects certain personal information (“Personal Information”) when you purchase a Mobi product or use one of our services. For example, you may provide us Personal Information like your name and date-of-birth when subscribing to service. Or, you may provide us with your credit card number, social security number or bank account information if you initiate automatic payment. Any Personal Information you give to us will be used in accordance with this Policy. We do not market, sell or disclose your personal information to unaffiliated third parties without your express written consent, or electronic equivalent.
We may use your Personal Information to inform you about new products and services from Mobi that we think may be of interest to you, but Personal Information is primarily used for market research, optimizing its systems in order to improve the customer experience, billing purposes, calculate the appropriate taxes, fees and other legal obligations to local, state and federal governmental entities, process orders, protect our rights and property and those of other customers, respond to emergencies or legal processes, or monitor the products and services used by the customer.
Mobi may from time to time contact you using your mobile phone’s text messaging service or by phone, mailers (to your residence or business), voicemail or email to inform you about our new products, services and upgrades. If you prefer to hear about new products by email rather than by phone or mailers, you may specify how you prefer to hear from us, in which case we will try to honor that request. Certain text messages sent to you through your phone may give you the opportunity to opt-out of such messages in the future. Remember, however, that you will still receive important customer service text messages and notices as to changes to any of our policies even if you opt-out of receiving information relating to products and services. Mobi may also sell a service where the customer purchases a text messaging package from our promotional partners offering discounts on products and services. If a customer purchases this optional service you will receive promotional text messages for the duration of the service. At no time does Mobi market or advertise via phone, mailers, email or text messaging strictly for the benefit of other companies or unrelated service and product providers.
Mobi occasionally uses your Personal Information to provide important notices to you. For example, Mobi sends monthly text messages to remind our customers that additional pre-payment is due for the upcoming month of service. If you use our automatic payment service, then you generally will not receive a monthly payment reminder. Mobi also sends text messages to update customers as to changes to this Policy or to the Terms and Conditions of Service. The customer is responsible for reading and understanding customer service related notices sent through your mobile phone.
Sensitive Personal Information such as your credit card number, social security number and bank account information are kept confidential. However, Personal Information intended for internal business uses may be disclosed to business partners to the extent necessary to complete a transaction or to perform a service requested by the customer, or in cases of Other Disclosers described below . For example, your credit card information is shared with the business partner to complete and collect payment from you in the event you pay by credit card, or for the download of ring tones and wallpaper provided by a business partner. Certain Personal Information may also be used for third party verification services to prevent fraud and identity theft.
Mobi’s policy is to retain Personal Information for only as long as is necessary for business and legal purposes.
Automatically Collected Information
If you dial 9-1-1 for emergency service, our network knows the approximate location of your phone. This information may be shared with emergency service providers, law enforcement officials and health care facilities.
Information From Outside Sources
Mobi may collect commercially available marketing information about you from third parties and use that information together with the Personal Information you provide to us and automatically-collected information. Mobi collects this information to better serve you and to inform you about new products and services that we believe may be of interest to you based on your likes and preferences. As with other Personal Information collected by Mobi, commercial marketing information that we collect about you will only be used in connection with your mobile service.
Customer Proprietary Network Information (“CPNI”)
There is a special category of personal information known as CPNI that is regulated under federal law. CPNI is information that Mobi obtains or creates when it provides mobile wireless telecommunications services to a customer. CPNI includes such information as call records, rate plans and billing details. Mobi may use your CPNI to provide and market mobile phone services to you based on your phone usage and rate plan. You may be able to opt-out of our using CPNI for this purpose. Your CPNI is not disclosed to third parties unless required by law. CPNI may be disclosed to an affiliate of Mobi for the purpose of marketing communications related services to you, but Mobi provides sufficient information to enable you to make an informed decision as to whether you want CPNI used in this manner before sharing the information. Mobi follows your directions if you choose not to allow us to share your information with an affiliate. Mobi limits the use of the personal information provided to an affiliate to the purpose for which the information was sent.
There are times when Mobi is under an obligation to disclose your Personal Information. First, disclosure of your Personal Information may be required by law or in good-faith reliance on legal process, or in connection with various regulatory filings. For example, Mobi discloses Personal Information to comply with court orders or subpoenas. Second, Personal Information may be disclosed to protect Mobi, its users, its affiliates and business partners from fraudulent, abusive, or unlawful use of any service or product. Third, we may share information with affiliates, and third parties who perform services on our behalf, including underlying wireless service providers. Fourth, Mobi, if it is involved in a sale, acquisition, merger or other type of asset transfer with another company or service provider, will notify you via our public website of changes in ownership or uses of Personal Information. Finally, subject to technological limitations, it is possible Mobi may disclose a customer’s approximate location and identity if we reasonably believe that an emergency involving immediate danger of death or serious physical injury requires notice to a governmental entity without delay.

We Protect your Personal Information
Mobi maintains safeguards to protect personal information provided through our website. When you log on to our Web site, order a service or product or make a payment online, Mobi employs encryption technology, such as Secure Sockets Layer (“SSL”) to protect your account information. While no security system is utterly fail-proof, Mobi endeavors to provide Web site resources that are free from third party interference.
Mobile Phone Security
Mobi implements systems in our network that are designed to prevent interception of your communications by third parties. Mobi systems also block and reduce unsolicited bulk text and Short Messages (“SMS”). There is no automated SMS entry point that does not have to pass through the bulk message prevention software. The goal is to keep your phone and the use of your phone free from intrusion. Although there is no absolute way to protect your phone from third party interference, our systems assure reasonable safeguards to your privacy while using Mobi services and phones. Mobi does not access to the content of private SMS and e-mail communications transmitted using Mobi services.
Mobi Employees and Agents
All Mobi employees and agents are responsible for safeguarding individual customer communications and information. All employees and agents are required to comply with this Policy. Customer accounts, records and reports are accessed for authorized business purposes only. The sharing of personal information with any third party without customer consent is strictly prohibited.
Mobi’s websites and services are not intended to attract minors (under the age of 18) and Mobi intends to restrict the purchase of products and services to adults (age 18 and over). Mobi does not knowingly collect information from minors. Wireless products and services purchased by adults for family use may be used by minors without the knowledge of Mobi, in which case, any information collected from the usage will appear to be the personal information of the actual adult subscriber and treated as such by this Policy.
